These Terms & Conditions ("Terms") govern your access to and use of the Palmetto Pool Solutions LLC website and any related services, estimates, scheduling, communications, and pool service work provided by Palmetto Pool Solutions LLC ("Palmetto Pool Solutions LLC," "we," "us," or "our"). By using our website, submitting a form, requesting service, or engaging us to perform work, you agree to these Terms.

If you do not agree, please do not use our website or Services.


1. Services

Palmetto Pool Solutions LLC provides pool-related services which may include weekly pool maintenance/cleaning, seasonal tune-ups, filter cleaning or replacement, minor repairs, and related pool equipment and water-care services (collectively, the "Services"). Specific scope, pricing, and scheduling may vary by pool, location, and condition.

All Services are subject to availability and service area coverage (including Lexington County, SC and Richland County, SC and surrounding areas).

2. Estimates, Pricing, and Changes to Scope

Estimates: Any quote or estimate is based on information available at the time and may require an onsite evaluation.

Scope changes: If conditions differ from what was described (e.g., heavy debris, algae bloom, equipment failure, unsafe access), additional work and charges may apply. We will attempt to communicate changes before proceeding when practical.

Promotions: Promotional offers (if any) may have limitations and may be changed or discontinued at any time.

3. Scheduling, Access, and Service Visits

By scheduling service, you agree to:

• Provide safe and reasonable access to the pool and related equipment on the service date (gate access, pets secured, clear pathway, equipment area accessible).

• Ensure the pool area is free from hazards (unsecured animals, aggressive pets, unsafe wiring, unstable decks, etc.).

• Notify us of any special instructions (alarm systems, locked gates, HOA rules, preferred entry).

Arrival times: We may provide a service window rather than an exact time due to routing, traffic, weather, and job complexity.

Utilities: Many services require electricity and water to be available at the property.

4. Weather and Service Interruptions

Weather, storms, power outages, water restrictions, or other events outside our control may delay or prevent service. If service must be rescheduled, we will make reasonable efforts to communicate and rebook as soon as possible.

5. Customer Responsibilities (Water Level, Equipment, and Pool Condition)

To help us deliver quality results, you agree to:

• Maintain appropriate water level unless otherwise instructed.

• Inform us of known issues (leaks, broken lids, faulty wiring, equipment problems).

• Keep equipment in a safe, serviceable condition.

Note: Some water clarity issues may require multiple visits and/or additional treatments depending on the cause (e.g., algae, filtration problems, phosphates, high bather load, storms).

6. Payments, Invoices, and Past-Due Balances

Payment terms may be communicated on your estimate, invoice, or service agreement. Unless otherwise specified:

• Payment is due as stated on the invoice.

• Past-due balances may result in paused or discontinued service until the account is brought current.

• You agree to pay any applicable taxes and approved fees.

If you have a billing question, contact us promptly so we can review it with you.

7. Cancellations and Rescheduling

If you need to cancel or reschedule, please contact us as soon as possible.

• We may charge a fee for late cancellations or missed appointments where travel/time has been committed, if applicable and communicated.

• We reserve the right to refuse service or discontinue recurring service for repeated missed appointments, unsafe conditions, or nonpayment.

8. Recurring (Weekly) Service Terms

If you enroll in weekly maintenance:

• Service frequency is typically weekly, but day/time may vary based on routing and conditions.

• Chemicals and certain parts may be included or billed separately, depending on your plan (as communicated).

• If access is unavailable or conditions are unsafe, the visit may be skipped or rescheduled, and charges may apply depending on the circumstances and plan terms.

We may recommend repairs or upgrades if equipment issues prevent proper maintenance results.

9. Repairs, Parts, and Warranties

• Any manufacturer warranties on parts are provided by the manufacturer, not by Palmetto Pool Solutions LLC, unless explicitly stated in writing.

• Labor warranties (if offered) will be communicated in writing on the invoice or service agreement.

• We are not responsible for pre-existing conditions, hidden defects, or failures caused by aging equipment, improper prior installation, or chemical imbalances outside our control.

10. Limitation of Liability

To the fullest extent permitted by law:

• Palmetto Pool Solutions LLC is not liable for indirect, incidental, special, consequential, or punitive damages.

• Our total liability for any claim related to Services will not exceed the amount you paid us for the specific Service giving rise to the claim.

• We are not responsible for damage or failure resulting from unsafe/defective equipment, pre-existing leaks, improper electrical supply, or conditions we could not reasonably detect during normal service.

Some states do not allow certain limitations, so these may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Palmetto Pool Solutions LLC from claims, damages, liabilities, and expenses arising out of or related to your misuse of the website, violation of these Terms, or unsafe conditions on your property that cause injury or damage to persons or property.

12. Website Use and Intellectual Property

All content on this website (text, images, logos, graphics, and design) is owned by or licensed to Palmetto Pool Solutions LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute website content without our prior written permission.
